Quick answer: Running an adult website in India is a crime. Publishing sexually explicit content online is punishable under IT Act Section 67A with up to 5 years in jail and a ₹10 lakh fine, and it is non-bailable. Anything involving minors, including drawn, anime or AI images, brings in IT Act 67B and POCSO, with minimum jail terms of 3 to 7 years. Developers who build, host or run such platforms are treated as the people who cause the content to be published. Hosting on Vercel, Render or offshore servers, using a VPN, foreign Gmail or US number, or earning through ads does not protect you. People are arrested for this in India every year, including B.Tech graduates in 2026.

Every year, thousands of students and young developers in India learn to build websites. And every year, some of them have the same idea: adult websites get massive traffic, traffic means ad money, and I already know how to build a website.

I had that thought too, as a student. What I did not know then was the law, the punishments, and how easily people are caught.

This guide is the complete overview of everything a developer needs to know before even considering building an adult website, app, Telegram channel or AI tool in India. Each section below gives you the essentials and links to a detailed article on that topic.

The 60-Second Version

If you read nothing else, read this:

  • Watching adult porn privately is not a crime in India. Building, hosting or running a porn website is.
  • IT Act 67A: up to 5 years jail and ₹10 lakh fine for publishing sexually explicit content. Non-bailable.
  • Child sexual abuse material (CSAM): minimum 5 years under POCSO Section 14. Anime, cartoons and AI images of minors count. The Supreme Court ruled in 2024 that even watching and downloading it is a crime.
  • Rape videos, revenge porn, hidden-camera footage and deepfake nudes bring additional charges. Rape itself carries a minimum of 10 years.
  • "I only wrote the code" is not a defence. The law punishes whoever causes content to be published.
  • Vercel, Render, Cloudflare and offshore servers do not hide you. VPN, cloud and VPS providers must keep your details for 5 years under CERT-In rules.
  • Foreign Gmail, US numbers, VPNs and fake accounts have failed in real cases.
  • Ad income is not allowed by Google AdSense, is prohibited by payment gateways like Razorpay, and leaves a money trail to your PAN and Aadhaar.
  • People get arrested. CBI raids at 76 and 59 locations, a life sentence in 2025, and B.Tech graduates arrested in 2026.

Private viewing of adult content is not a crime. Publishing it is.

In September 2023, the Kerala High Court held that watching porn privately, without showing or distributing it, is not an offence under the old obscenity law. But the moment content is published, transmitted, sold or exhibited, the law applies. A website is, by definition, publishing to the public.

There is no private-viewing exception for child sexual abuse material. Watching, downloading or storing it is always a crime.

2. The Laws and Punishments

Five main laws apply to porn websites in India, and a single site can be booked under several of them at once.

Law and SectionOffenceFirst ConvictionBail
IT Act 67Publishing obscene materialUp to 3 years + ₹5 lakhBailable (first offence)
IT Act 67APublishing sexually explicit materialUp to 5 years + ₹10 lakhNon-bailable
IT Act 67BChild sexual abuse materialUp to 5 years + ₹10 lakhNon-bailable
POCSO 14Using a child for pornographyMinimum 5 years + fineNon-bailable
POCSO 15(3)Storing CSAM for commercial purposes3 to 5 yearsNon-bailable
BNS 294Selling, distributing or profiting from obscene materialUp to 2 years + fineBailable
IRW Act 6Indecent representation of womenUp to 2 years + fineBailable

Repeat convictions go up to 7 years under IT Act 67A and 67B, and to a minimum of 7 years under POCSO 14.

Why developers are held liable

  • Sections 67, 67A and 67B punish anyone who causes content to be published. Building the platform, writing the upload logic and deploying the server is exactly that.
  • Safe harbour under Section 79 does not protect a platform built for illegal content, or one that ignores complaints.
  • Abetment is a crime. A freelancer who knowingly builds such a platform can be named in the case.
  • Section 85 makes every person in charge of a company liable for offences committed by it.

3. Child Sexual Abuse Material: Zero Tolerance

This is the most serious category, and every developer who builds anything with uploads needs to understand it.

  • Anyone under 18 is a child. Any sexual depiction of them, whether real, drawn, animated, AI-generated or written, is illegal.
  • POCSO 14: minimum 5 years for using a child for pornography (minimum 7 on repeat).
  • POCSO 15(3): 3 to 5 years for storing it for commercial purposes, and ads or subscriptions count as commercial.
  • In Just Rights for Children Alliance v. S. Harish (September 2024), the Supreme Court held that viewing, downloading and storing such material is an offence, and that deleting it later does not erase liability.
  • Global platforms report CSAM to NCMEC in the US, which shares it with India's NCRB. More than 69 lakh such reports had been shared with Indian states by March 2024.
  • The CBI has run nationwide raids: Operation Carbon (2021) at 76 locations and Operation Megh Chakra (2022) at 59 locations across 21 states and 1 UT, including Uttarakhand.

4. Rape Videos, "Forced" Porn, Revenge Porn and Deepfakes

Content where someone never consented is treated as one of the most serious online crimes.

  • Consent to record is not consent to share. BNS 77 (voyeurism) explicitly covers dissemination: 1 to 3 years, rising to 3 to 7 on repeat.
  • IT Act 66E punishes sharing images of someone's private areas without consent: up to 3 years.
  • Rape carries a minimum of 10 years under BNS 64, and gang rape a minimum of 20 years.
  • Since 20 February 2026, platforms must remove non-consensual intimate imagery, including deepfake nudes, within 2 hours of a complaint.
  • Real cases: a life sentence in 2025 for a former MP who recorded his assaults; 5 years in jail for revenge porn in 2018; the Rajkot hospital CCTV racket in 2025; MeitY's action against Grok in January 2026; and a B.Tech graduate arrested for AI deepfakes in Delhi in September 2026.
  • Building a "nudify" or face-swap app for real people's photos makes you part of every crime committed with it.

6. Why Hosting on Vercel, Render or Offshore Servers Won't Hide You

  • Indian law follows you, not your server. If you run the site from India, the offence happens in India. IT Act Section 75 also extends the Act to offences outside India involving computers in India.
  • Vercel and Render prohibit illegal and sexually exploitative content and can suspend accounts instantly.
  • Cloudflare forwards abuse complaints to your host and shares your origin IP with them.
  • Every website leaves a trail: domain registrar, hosting account, GitHub commits, payment gateway, email and ISP records. Police need only one link.
  • Police obtain records using BNSS Section 94 orders.
  • Under the CERT-In directions of 2022, cloud, VPS and VPN providers must keep customers' validated details for 5 years, even after the account is closed.
  • Offshore hosting adds a foreign money trail, still gets blocked in India, and proves you knew it was illegal. In the Hotshots case, a London company did not stop arrests in Mumbai.

7. Why a Foreign Gmail, US Number or VPN Won't Save You

  • Anonymity tools hide you from people, not from police. Every one is a company with logs and a legal team.
  • Email providers record signup IPs, recovery numbers and every login.
  • A fake or borrowed SIM is a separate crime under the Telecommunications Act, 2023: up to 3 years and ₹50 lakh.
  • Fake accounts add charges under IT Act 66C and 66D.
  • Real cases: the Bulli Bai app on GitHub led to four arrests in 2022, and in September 2026 a B.Tech graduate using multiple Gmail IDs and fake accounts was arrested in Delhi.
  • Trying to hide makes it worse: it proves intent, adds charges and makes bail harder.

8. Can You Earn From Ads on an Adult Website?

  • No. The site itself is illegal under IT Act 67A, and profiting from it adds BNS 294.
  • Google AdSense does not allow ads on sexually explicit content and can terminate accounts.
  • Razorpay lists pornography as the first item in its prohibited businesses.
  • Every rupee leaves a trail to your PAN, Aadhaar and phone number. In the 2026 Hardoi case, police found around ₹1.2 crore in the accused's bank accounts.
  • Unexplained income can be taxed at an effective rate of about 78%, accounts can be frozen, and the ED can launch a money laundering probe, as in the Hotshots case.

What Happens If You're Caught?

Even before any verdict, an arrest means:

  • Devices seized for forensic analysis, which recovers deleted files
  • Custody, because IT Act 67A, 67B and POCSO offences are non-bailable
  • Frozen bank accounts and possible attachment of property
  • Your name in the news
  • Years of trial, lawyer fees and court dates
  • A criminal case that shows up in background checks for every tech job you apply to

Build Something You Can Put Your Name On

If what attracted you was building something that earns while you sleep, your skills are valuable. Use them on:

  • SaaS products for small businesses
  • Templates, UI kits and developer tools you can sell
  • Content sites monetised with legitimate ad networks
  • Freelance and client projects that build your portfolio
  • Courses and tutorials on what you already know
  • Responsible sexual health education without explicit content

Every one of these lets you declare your income, show your work in interviews, and sleep peacefully.

Key Takeaways

  • Running an adult website in India is a crime. IT Act 67A alone means up to 5 years and is non-bailable.
  • CSAM, rape videos, revenge porn and deepfakes are zero-tolerance categories with the harshest punishments.
  • Developers are not "just developers" in the eyes of the law. Building and hosting is publishing.
  • Hosting abroad, VPNs, foreign accounts and fake identities do not protect you.
  • Ad and subscription income is blocked by legitimate platforms and creates a money trail.
  • People are arrested every year, including engineers and B.Tech graduates in 2026.
